Terms of Service

These Terms of Service (“Terms”) govern your use of the Boxie POS applications, cloud services, and website (the “Service”), provided by Xyclotec Solutions (“Boxie POS,” “we,” “us”). By using the Service you agree to these Terms and our Privacy Policy.

1. Acceptance of terms

By creating an account or using the Service, you agree to these Terms. If you don’t agree, don’t use the Service.

2. Eligibility

You must be at least 18 and able to enter into a contract. The Service is intended for businesses and their authorized staff.

3. Accounts

You’re responsible for the accuracy of your account information, for keeping your credentials secure, and for activity under your account. Tell us promptly if you suspect unauthorized access. You consent to receive transactional messages (such as verification codes and security alerts) while your account is active.

4. Acceptable use

Don’t use the Service to break the law, infringe others’ rights, disrupt or probe the Service, upload malicious code, or attempt to access accounts or data that aren’t yours. We may investigate and act on violations.

5. Subscriptions & payments

Paid plans are billed on a recurring basis and renew automatically unless cancelled before the renewal date. Fees are non-refundable except where required by law. We’ll give notice of price changes. Any trial or early-access terms will be described when offered.

6. Your data

Your business data is yours. You grant us the limited rights needed to host, process, sync, back up, and display it to operate the Service for you. You’re responsible for the data you enter and for having the right to use it.

7. Intellectual property

The Service, including its software, design, and trademarks, is owned by Xyclotec Solutions. You may not copy, modify, or distribute it except as these Terms allow.

8. Availability

We work to keep the Service reliable, and your registers keep working offline if the cloud is unreachable. We may perform maintenance and can change or discontinue features over time.

9. Disclaimers

The Service is provided “as is” without warranties of any kind to the extent permitted by law. We don’t warrant that it will be uninterrupted or error-free.

10. Limitation of liability

To the maximum extent permitted by law, our total liability arising from the Service is limited to the amount you paid us in the 12 months before the claim, or US $100, whichever is greater. We’re not liable for indirect or consequential damages.

11. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate access if you breach these Terms. On termination your right to use the Service ends; data handling follows our Privacy Policy.

12. Governing law & disputes

These Terms are governed by the laws of the State of Delaware, USA. The parties will try to resolve disputes informally first; unresolved disputes are subject to the exclusive jurisdiction of the courts located in Delaware, except where applicable law provides otherwise.

13. Changes to these terms

We may update these Terms from time to time. We’ll post the new version here and, where appropriate, notify you. Continued use means you accept the changes.
